August 2, 2000  W.R. Grace and Baker & Taylor

W.R. Grace & Co., and a former subsidiary, Baker & Taylor Inc., a national book distributor, have agreed to pay $15.5 Million Dollars to settle claims allegations that they overcharged schools, libraries and government agencies on book sales for more than a decade.

In an action under the False Claims Act, the claims asserted against Baker and Taylor were that in selling books to government entities and agencies, they had agreed to give discounts of approximately 40% on the price of “trade books,” but then failed to provide the full discounts by misclassifying various trade books into non-trade categories. Meanwhile, the company provided full trade discounts on the same books to commercial retailers.
