April 27, 2010 — AstraZeneca L.P.

AstraZeneca LP and AstraZeneca Pharmaceuticals have agreed to pay $520 Million to settle qui tams claim filed against them by a private Relator, James Wetta.

The allegations of the case were that AstraZeneca illegally marketed the anti-psychotic drug Seroquel for uses not approved as safe and effective by the Food and Drug Administration (FDA). Such uses are known as “off-label” uses, because they are not included in the drug’s FDA approved product label.

By marketing Seroquel for unapproved uses, the company caused the submission of false claims seeking payment from Medicaid, Medicare, TRICARE and the Federal Employee Health Benefits Program (FEHBP)

As a reward for having filed his qui tam claim, Mr. Wetta will receive $45 million.
